Terms and Conditions
1. Acceptance of Terms
1.1 These terms and conditions govern all supply of digital goods (including eBooks) and services (including workshop tickets) ("products") by MarketHer, "we", "us") to you, the purchaser of goods and services from us, including your use of the website at www.markether.co.nz and www.markether.nz ("the website").1.2 These terms are effective from 20th September 2024 and will replace all earlier MarketHer terms of trade.
1.3 We may change these terms at any time by posting revised terms on our website. By continuing to use our services or purchase products, you agree to be bound by any changes.
1.4 To make a purchase from our online store, you must be 18 years of age or over.
1.5 Purchases from our online store may only be made for personal use or consumption. You must not acquire products from us for resupply or other commercial purposes.
1.6 If you are purchasing on behalf of another entity (e.g., a company), you warrant you have the authority to agree to these terms and conditions on behalf of that entity.
2. Products & Availability
2.1 Our offerings include digital products (e.g., eBooks) and workshop tickets. We do not ship any physical goods.2.2 All orders are subject to the availability of the relevant product. If a product or service is no longer available, we will endeavour to notify you on our online store.
3. Pricing and Payment
3.1 All prices are stated in New Zealand Dollars (NZD) and include GST (Goods and Services Tax), unless otherwise noted.3.2 We reserve the right to alter prices at any time. If you have already placed an order, the price will be as agreed at the time of purchase.
3.3 You will receive an invoice at the email address you provide during checkout; please ensure your contact details are correct.
3.4 Accepted Payment Methods
- Credit Cards: Visa, MasterCard, American Express
- Stripe: Payments processed via Stripe are subject to Stripe's terms and conditions, which can be found at https://stripe.com/nz/legal.
- Afterpay: If you choose to pay via Afterpay, you agree to Afterpay's terms, available at https://www.afterpay.com/en-NZ/terms-of-service.
4. Digital Products (eBooks)
4.1 No Returns or Refunds: Once purchased, no returns or refunds will be provided for eBooks or other downloadable digital content.4.2 Copyright & Intellectual Property
- All eBooks and digital products are copyrighted and protected as our intellectual property (or that of our licensors).
- Upon purchase, you are granted a non-transferable, non-exclusive license to download and use the eBook for personal use only.
- Prohibited Sharing: You must not copy, distribute, or share the digital files with third parties. Any unauthorised reproduction or sharing may constitute copyright infringement.
5. Workshops & Ticket Sales
5.1 Workshop Tickets: By purchasing a ticket to any of our workshops, you agree to the following refund terms:- Partial Refund (Non-Attendance): If you cannot attend and notify us at least 24 hours prior to the workshop start time, you will be refunded 80% of the ticket price.
- Change of Mind: If you simply change your mind, you must notify us at least 2 weeks before the scheduled workshop so we have a chance to re-sell your spot. We reserve the right to determine the amount of refund (if any) based on the likelihood of filling your spot and any costs we have already incurred.
5.2 If the workshop is postponed or cancelled by us, we will notify you as soon as possible and offer you a rescheduled date, a full refund, or a credit (at our discretion).
6. Consumer Guarantees Act & Liability
6.1 Consumer Guarantees Act 1993 (CGA): Where you acquire or hold yourself out as acquiring goods or services from us for the purposes of a business, the provisions of the CGA will not apply.6.2 Exclusions: To the maximum extent permitted by law, all conditions, warranties, and guarantees implied by statute or common law are excluded.
6.3 No Liability for Indirect Loss: We endeavour to ensure the accuracy of all information on our website. However, to the greatest extent permissible by law, we exclude liability for any indirect or consequential loss or damage arising from your use of our site or purchase of products.
6.4 Our Maximum Liability: If we are found liable for any reason, our maximum liability to you is limited to the purchase price of the products or services in question.
7. Privacy & Confidentiality
7.1 Data Collection: We collect personal information (e.g., name, email address) to process orders and manage your account.7.2 Opt-In Communications:
- If you choose to receive marketing communications from us, you can opt out at any time by contacting us or following the unsubscribe instructions in our emails.
- Opting out of marketing emails will not prevent us from sending you service-related messages (e.g., order confirmations).
7.3 Cookies: We may use cookies to enhance your browsing experience. If you disable cookies, some website features may not function properly.
7.4 Disclosure: We may disclose your personal information only as required by law or as necessary to process your order (e.g., providing your name/address to payment providers).
7.5 Security: While we take reasonable steps to secure our website, we cannot guarantee perfect security. We will not be liable for any breaches of security beyond our reasonable control.
7.6 Access to Your Information: You can request a copy of your personal information at any time and ask us to correct any inaccuracies.
8. General Conditions
8.1 Jurisdiction: These terms are governed by the laws of New Zealand, and the courts of New Zealand shall have non-exclusive jurisdiction.8.2 Entire Agreement: These terms constitute our entire agreement with you and supersede any prior discussions or agreements.
8.3 Notices: We may deliver notices to you by email to the address you have provided.
8.4 No Waiver: If we do not exercise or enforce any right available to us under these terms, it does not constitute a waiver of those rights.
8.5 Severability: If any provision is deemed invalid, the remaining provisions shall remain in full force and effect.
8.6 Third-Party Rights: Except as expressly stated, these terms do not confer a benefit on any third party.
